Terms of Service
These Terms govern access to and use of the VitalView AI emergency CT screening platform provided by Vital View AI Pvt. Ltd. ("VitalView AI", "we", "us"). By using the platform, the hospital or clinic ("Customer") and its authorised users agree to these Terms. Where a signed master agreement exists between us, that agreement controls if it conflicts with these Terms.
1. The service
VitalView AI screens emergency CT studies and prepares a structured first-read draft, working through the Customer's existing PACS and DICOM infrastructure. The service is provided to hospitals and clinics, not to individual patients or consumers.
2. Clinical responsibility
VitalView AI produces preliminary draft reports intended for use by qualified clinicians only. They are not intended for standalone or autonomous diagnostic use. Every report must be reviewed and signed by a qualified clinician, who remains responsible for the final diagnosis and clinical decision. The Customer is responsible for ensuring qualified clinicians review every output.
3. Acceptable use
The Customer will use the platform only for lawful clinical purposes and in line with these Terms. The Customer will not attempt to reverse engineer, disrupt, or gain unauthorised access to the platform, and will keep account credentials secure. The Customer is responsible for the actions of its authorised users.
4. Customer data
The Customer retains ownership of its patient data and study records. The Customer grants us the limited rights needed to process that data to deliver the service. Our handling of patient and account data is described in our Privacy Policy.
5. Regulatory status
VitalView AI is pursuing a CDSCO Software as a Medical Device pathway. The service is offered on the basis described in the applicable agreement and within the intended use stated above. The Customer is responsible for using the service in compliance with the regulations that apply to its practice.
6. Fees
Fees are set out in the applicable order or agreement, including any per-scan pricing. Unless otherwise agreed, fees are exclusive of taxes, which the Customer is responsible for.
7. Availability
We work to keep the platform available and performing well, but we do not guarantee uninterrupted operation. We may carry out maintenance and may update the service to improve it, in line with any service levels set out in the applicable agreement.
8. Disclaimers and liability
To the extent permitted by law, the platform is provided on an "as is" basis, and the draft outputs do not replace clinical judgement. Our liability is limited as set out in the applicable agreement. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Term and termination
These Terms apply for as long as the Customer uses the platform. Either party may end the engagement as set out in the applicable agreement. On termination, we will delete or return patient data as described in our Privacy Policy.
10. Governing law
These Terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute, unless the applicable agreement states otherwise.
